CEO Corner Week of 8/11/26: The FY 2026 NOFO is Vacated

So, as you have probably seen by now, the District Court of Rhode Island issued summary judgment in our lawsuit against HUD regarding the FY 2026 NOFO. Although the Court declined to issue a permanent injunction (which we’ve come to expect), the FY 2026 NOFO itself and its deadlines are vacated in full.

This means that HUD cannot move forward with the drastic changes in the NOFO, including the set-aside (described by the Court as “colossal”) that would have forced communities to transition programs away from evidence-based permanent housing solutions en masse. More importantly, it means that at least 97,000 formerly homeless people will continue to know the safety and stability of a home.

This process has been confusing for us all, and we cannot say with certainty what HUD’s next move will be. What we can tell you is that we are urging HUD to acknowledge the Court’s decision by expeditiously communicating that the CoC Program Competition can no longer move forward so each of you can have some reprieve from the chaos of the last year and a half.

That said, we are grateful for everyone’s patience and hard work during these difficult times. We pledge that the Alliance will always be responsive to the needs of our members and people experiencing homelessness everywhere. Communities across this nation — in states both red and blue — rely on the federal government to support smart, strategic, lawful, and evidence-based funding opportunities to support their efforts to end homelessness. This is HUD’s responsibility. This decision further reinforces that this administration has repeatedly failed to meet that responsibility.
